By booking a session or utilising any services provided by Shootscape Photography ("Shootscape", "we", "us"), you ("the Client") agree to the following terms and conditions. These terms are governed by the laws of New South Wales, Australia.
1. Copyright & Intellectual Property
All photographs, images, video, 3D virtual tour content and associated digital files produced by Shootscape Photography remain the intellectual property of Shootscape Photography at all times. Shootscape Photography retains full copyright of all images under the Copyright Act 1968 (Cth).
Upon full payment, the Client is granted a non-exclusive, non-transferable licence to use the delivered images for the purposes agreed at the time of booking (e.g. property marketing, commercial use). Images may not be resold, sub-licensed or transferred to a third party without prior written consent from Shootscape Photography.
Shootscape Photography reserves the right to use any images produced for portfolio, website, social media and marketing purposes, unless the Client provides written notice requesting otherwise prior to the session.
2. Bookings & Payment
A booking is confirmed upon receipt of a deposit or written confirmation from Shootscape Photography. The balance of the invoice is due within 7 days of delivery of the final images unless otherwise agreed in writing.
Invoices not paid within 14 days of the due date may attract a late payment fee. Shootscape Photography reserves the right to withhold delivery of final images or files until payment is received in full.
Prices are quoted in Australian Dollars (AUD) and are inclusive of GST where applicable.
3. Cancellations & Rescheduling
Cancellations made more than 48 hours before a scheduled session will receive a full refund of any deposit paid. Cancellations made within 48 hours of the session may forfeit the deposit.
Rescheduling requests made with more than 24 hours notice will be accommodated at no extra charge, subject to availability. Rescheduling within 24 hours of the session may incur an additional travel or rebooking fee.
In the event that Shootscape Photography must cancel a session due to unforeseen circumstances, the Client will receive a full refund or be offered an alternative date.
4. Delivery of Images
Edited images will be delivered digitally via an online gallery or download link within the agreed timeframe. Standard turnaround for real estate photography is 24 hours from the date of the shoot unless otherwise communicated.
The number of final edited images delivered will be as agreed at the time of booking. Shootscape Photography retains sole discretion over which images are selected for editing.
Raw (unedited) image files are not provided unless expressly agreed in writing prior to the session.
5. Limitation of Liability
Shootscape Photography will take all reasonable care during a session. However, Shootscape Photography will not be liable for any loss or damage arising from: technical equipment failure, theft, accidental loss of digital files, events beyond our control (including extreme weather, road closures, or access restrictions).
In the event of equipment failure or similar unforeseen issue, liability is limited to a refund of fees paid. Shootscape Photography is not liable for any indirect, consequential, or economic loss.
Aerial photography is subject to CASA regulations and local airspace restrictions. Shootscape Photography will not fly in controlled airspace or in conditions that compromise safety or compliance, and no refund is provided where a shoot is aborted due to regulatory or safety restrictions that were not foreseeable at the time of booking.
6. Privacy
Shootscape Photography is committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
Personal information collected (including name, address, email and phone number) is used solely for the purpose of providing photography services and communicating with clients. This information will not be sold or shared with third parties without your consent.

7. Property Preparation
For the best results, the Client is encouraged to ensure the property is clean, tidy, and ready for photography prior to the photographer's arrival. Shootscape Photography is not responsible for the final appearance of any space that has not been adequately prepared.
If a property is not ready upon arrival and the photographer must wait or return, an additional fee may apply for the waiting or return visit time.
For 3D virtual tour scans, all doors should be open, lights should be on, and unnecessary clutter should be removed prior to scanning commencement. The scan captures the space as-is at the time of the appointment.
8. Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through good faith negotiation before escalating to formal proceedings.
If a dispute cannot be resolved informally, it shall be subject to the laws and courts of New South Wales, Australia.

9. General
These Terms and Conditions constitute the entire agreement between Shootscape Photography and the Client in relation to the services provided.
Shootscape Photography reserves the right to update these Terms and Conditions at any time. Updated terms will be published on this page and the date of last update will be amended accordingly.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue to apply.
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia.

360 images, 3D Virtual Tour scans and panoramic virtual tours (including Google Street/Business View) are typically available between 24 and 48 hours* after the shoot. The images are edited and optimized for quality before delivery to our Clients. Images may be delivered via email (zip file, Google Drive, Dropbox) per special request.
3D Virtual Tour scans are hosted on 360Pros’ personal Matterport Cloud Server, and are licensed to the Client for 1 year starting on the delivery date unless otherwise agreed upon. Long-term hosting for up to 5 years can be made available in some cases. In the unlikely event of 360Pros’ dissolve, the Client can self-host the 3D Virtual Tours on their own Matterport account. 360Pros can transfer all necessary data to the Client.
Panoramic virtual tours are uploaded to the 360Pros web hosting channels, and delivered to the client via web URL and embed URL. The method of licensing is determined during pre-production and will be agreed upon and included with the estimate. The Client has the option to licence the panoramic virtual tour via subscription, or self host and own full content rights for an additional fee to be agreed upon during pre-production.
Google Street View/Business View virtual tours are hosted on the 360Pros’s Google Account. The Client has the option to upload and arrange the 360 panoramic photos themselves (upon online delivery from 360Pros), or hire 360Pros to upload and transfer the virtual tour to the Client’s Google Account at an additional fee to be agreed upon during pre-production.
360 video production times vary depending on the complexity of film. Completed 360 videos are uploaded to the 360Pros YouTube and/or Vimeo 360 channels, and licensed to the client for a length of time determined at the time the original estimate is given. Video files are also available upon request via Google Drive/Dropbox at an additional fee to be agreed upon during pre-production.
Aerial 3D scans/ Exterior 3D models are typically available within five to seven business days* of the shoot. Completed 3D models are uploaded to the 360Pros web hosting channels, and delivered to the client via web URL and embed URL. The Client has the option to licence the content via monthly, or annual payments. Additionally, Client can self host and own full content rights for an additional fee to be agreed upon during pre-production.
The Client will receive an email once the media has been processed, and will receive the deliverable within the email via any of the following depending on the type of deliverable: web URL, embed URL, attached zip file, Google Drive file, or Dropbox file. (If necessary, other forms of online storage can be discussed prior to the appointment date). Additional assistance to obtain the delivered files and step through instructions to uploading or embedding the media to a website can be purchased for an extra fee.
*Delivery times are approximations based on averages. Larger projects with custom requirements take longer to process.
